    • That neither I, nor anyone at my residence is currently a DIRECTV subscriber, nor have ever been a DIRECTV subscriber. (If you're currently a DIRECTV customer and purchasing just a receiver, this line is not applicable.)
    • To activate my system and all receivers with Total Choice Programming ($33.99/mo.) or greater within 31 days of receipt. ALL RECEIVERS PURCHASED MUST BE ACTIVATED AT THE SAME TIME AND ALL RECEIVERS MUST MAINTAIN AT LEAST 12 CONSECUTIVE MONTHS OF DIRECTV® PROGRAMMING, $33.99 TOTAL CHOICE® OR ABOVE.
    • To activate the system at the residential location provided with my order (you also must activate with the same phone number you provided us as well.)
    • If you do not activate all receivers within 30 days according to the activation guidelines above or you do not meet the new first time DIRECTV Customer requirements above, or the system is not installed at the installation address you have provided on the bottom of this agreement, you agree to pay a non refundable fee of $350 per DIRECTV DVR with Tivo receiver and $225 per receiver for all other receivers as liquidated damages to the credit card you have provided to Aquarius Communications Inc. for the purchase of your system. If the credit card does not have sufficient credit, any balance owed is due and payable immediately.
    • That the shipping and handling fee is non-refundable.
    • That if for any reason I decide to return the equipment prior to activation, I am responsible for any shipping fees incurred.
    • That in order to receive DIRECTV service I must have a clear and unobstructed view to the southern skies over Houston, Texas.
    • I am subject to a credit check by DIRECTV at the time of activation.
    • Aquarius Communications, Inc. is not responsible for any overdraft/over-the-limit charges or bank fees if your account contains insufficient funds when your order is processed, billed, or assessed any non-activation fees. To prevent this from happening, we recommend using a credit card rather than a debit card.
    I also understand that my purchase includes FREE standard professional installation, and that I am responsible to pay the installer for any custom work required.

Activation Commitment: Within 30 days of purchase of your DIRECTV System equipment, you agree to activate a DIRECTV programming package valued at $33.99 per month or above, or DIRECTV PARA TODOS™ OPCIÓN ESPECIAL or above, or Phoenix TV programming package. You also agree to activate DIRECTV programming on any additional receivers ($4.99 per month per additional receiver as long as all receivers are connected to the same phone line). Existing DIRECTV customers may activate receivers with their existing DIRECTV® programming package.

Consequences of Your Failure to Activate Programming: If you fail to activate your DIRECTV System equipment within 30 days of purchase date, you agree that Aquarius Communications, Inc. may charge a fee of one hundred seventy-five U.S. dollars as liquidated damages, per DIRECTV System that is not activated.

Customers in NRTC Territory: This Agreement does not apply to customers who activate DIRECTV System equipment in a territory served by members or affiliates of the National Rural Telecommunications Cooperative.

Programming Commitment: Within 30 days of purchase of your DIRECTV System equipment, you agree to activate a DIRECTV® TOTAL CHOICE® programming package valued at $33.99 per month or above or DIRECTV PARA TODOS™ OPCIÓN ESPECIAL® or above or PhoenixTV programming package, and maintain such programming package for a period of twelve (12) consecutive months (without interruption) for each DIRECTV System purchased by you, including additional DIRECTV receivers ($4.99 per month per additional receiver as long as all receivers are connected to the same phone line). After you have fulfilled your twelve (12) month commitment to the required programming package, you are not obligated to continue your subscription for DIRECTV® programming for any specific duration. Existing DIRECTV customers may activate additional receivers with their existing DIRECTV® programming package.

Consequences of Your Failure to Maintain Programming Commitment: If you fail to maintain and pay for twelve (12) consecutive months of the required programming package, you agree that DIRECTV may charge you a prorated fee of up to one hundred fifty U.S. dollars ($150.00).

THIS PROGRAMMING COMMITMENT IS SEPARATE AND DIFFERENT FROM ANY OTHER ANNUAL COMMITMENT YOU MAY HAVE PREVIOUSLY MADE WITH DIRECTV AND IS FULLY ENFORCEABLE UNDER THESE TERMS.

DIRECTV Customer Agreement: You hereby agree and acknowledge that this DIRECTV Annual Programming Commitment Agreement sets forth additional terms and conditions regarding your receipt of DIRECTV® programming and activation of access cards and shall be applied in conjunction with the DIRECTV Customer Agreement, a copy of which is provided at DIRECTV.com and with your first bill.

Arbitration: You and DIRECTV agree that both parties will resolve any dispute arising under this Agreement through binding arbitration as set forth in the DIRECTV Customer Agreement.

Customers in NRTC Territory: This Agreement does not apply to customers who activate DIRECTV System equipment in a territory served by members or affiliates of the National Rural Telecommunications Cooperative. Thank you for choosing to purchase DIRECTV System equipment. By signing this Annual Programming Commitment Agreement, Customer (hereafter referred to as “I”/”me”/“you”/”your”) agrees to abide by the following terms and conditions.
